Jury waivers appear to be governed by common law as indicated in the case law.

Cases

In Pennsylvania, the right to a jury trial may be waived by conduct or by express statement. Eighth North-Val, Inc. v. Parkinson, 773 A.2d 1248, 1256 (Pa. Super. 2001). The ability of parties to a contract to waive their right to a jury trial was deemed constitutional under the Pennsylvania constitution as early as 1874 and remains the rule today. Krugh v. Lycoming Fire Ins. Co., 77 Pa. 15, 1874 WL 13231 (Pa. 1874).
