Factors to be considered in awarding attorney fees are laid out in ORS 20.075.
Cases
Attorney fees are recoverable in Oregon only when authorized by statute or by the contract. Domingo v. Anderson, 325 Or. 385, 388 (1997). Attorney fees cannot be allowed on appeal in the absence of express language authorizing the fees on appeal.Malot v. Hadley102 Or. App. 336, 340 (1990)
Comments
The attorney fee clause should provide for recovery of attorney fees in any appeal, arbitration, and bankruptcy proceeding.
