Choice of Law
Statutes
"Montana statutes mention conflict of laws in respect to statutes of limitations. If a claim is substantively based upon the law of one other state, the limitation period of that state applies; or upon the law of more than one state, the limitation period of one of those states chosen applies.(MCA 27-2-503) If the statute of limitations of another state applies to the assertion of a claim in Montana, the other state's relevant statutes and other rules of law governing tolling and accrual apply in computing the limitation period but its statutes and other rules of law governing conflict of laws do not apply. (MCA 27-2-504)
When a transaction bears a reasonable relation to this state and also to another state or nation, the parties may agree that the law either of this state or of the other state or nation shall govern their rights and duties. (MCA 30-1-301)
If the law chosen by the parties to a consumer lease is that of a jurisdiction other than a jurisdiction in which the lessee resides at the time the lease agreement becomes enforceable or within 30 days thereafter or in which the goods are to be used, the choice is not enforceable. (MCA 30-2A-106)"
