"A person claiming the right to immediate possession of personal property may file an action for possession before judgment.in the District Court and must comply with certain procedures. Maryland Rule §12-601.

District Court has exclusive original civil jurisdiction in an action of replevin, regardless of the value of the thing in controversy and a petition for injunction relating to the use, disposition, encumbrances, or preservation of property that is claimed in a replevin action, until seizure under the writ. Md. Code, Cts. & Jud. Proc.; § 4-401.

A lessee has a right of replevin, detinue, sequestration, claim and delivery, or the like for goods identified to the lease contract if after reasonable effort the lessee is unable to effect cover for those goods or the circumstances reasonably indicate that the effort will be unavailing. Md. Code, Com; § 2A-521."

Comments

Replevin actions may be brought in the United States District Court for the District of Maryland in matters for which diversity jurisdiction exists and the other elements of the cause of action also exist.
