Statutes
When a transaction bears a reasonable relation to the state and also to another state or nation the parties may agree that the law either of this state or of such other state or nation shall govern their rights and duties. (Ga. Code Ann., § 11-1-301)
Cases
Additionally, forum selection clauses in contracts are prima facie valid and should be enforced unless such enforcement would be unreasonable under the circumstances or would violate a strong public policy of the forum. Bunker Hill Intern., Ltd. v. Nationsbuilder Ins. Services, Inc., 309 Ga. App. 503, 710 S.E.2d 662 (2011)
Comments
Generally speaking, forum selection clauses will be enforced by courts if invoked by the parties.
