The general assembly permits the recovery of attorney fees or licensed legal paraprofessional fees in courts when the bringing or defense of an action is determined to have been substantially frivolous, substantially groundless, or substantially vexatious. (C.R.S. 13-14-101)
With the approval of the court, two or more parties to an action may agree, by written stipulation filed with the court or by oral stipulation in open court, to no award of attorney fees or licensed legal paraprofessional fees or an award of attorney fees or licensed legal paraprofessional fees in a manner different than prescribed by law. (C.R.S. 13-17-105)
